Chair of civil law disciplines
The chair of Civil law disciplines as an independent structural division has been functioning since 1976. Heads of the department were: Doctor of law Boush Eduard Petrovich (1976-1977), Mukhamedjanov Alimjon Sharipovich (1977-1983), Doctor of law, associate professor Shamil Asyanov Mudarisovich (1983- 1997), Doctor of law, associate professor Tulteev Ilyas Tavasovich (1997-2000), Doctor of law, professor Holmuminov Jumanazarov Toshtemirovich (2000-2008), Doctor of law, associate professor Turgunov Murodjon Tursunbaevich (2008-2009), Doctor of law, associate professor Kamalov Oybek Akhmatovich (2009-2013, 2017-2018).
During the functioning of the chair is carried out following fundamental research work: E.P. Boush «Contractual relations of the institutions of interior with economic organizations» (1975), «Civil-legal protection of property and participation of the organs of internal affairs in it» (1977), «Legal issues of releasing property from seizure» (1981); Mukhamedjanov A.Sh. «Material liability of rank and commanding staff in the organs of internal affairs» (1981), «New legislation about guarantees of labor rights of workers and employees» (1981), «Labour contract» (1982); Asyanov Sh.M. «Some problems of housing legislation» (1981), «Some problems of administrative resettlement and participation of the organs of internal affairs in it» (1985); Avanesov E.V. «Concept and classification of civil-legal safety devices of property rights» (1994), «Civil-legal safety devices of property rights» (1998); Rahmankulov H. «Commentary to the first part of the Civil Code of the Republic of Uzbekistan» (1997), Kuldashev N.A. “Civil problems of indemnification caused by the organs of internal affairs”. Subsequently, the significant part of the conclusions of this research work was relevant in preparation of new Civil Code of the Republic of Uzbekistan.
Scientific and pedagogical activities at the chair were carried out by Yakubov S.A. (1976-1981), Tulpanov F.M. (1978-1995), Utaev M.A. (1980-1992, 1999-2000), Rakhmatullaev G. (1983-1988), Buturlin E.S. (1985-1987), Djumamuratov Sh.Y. (1986-1994), Davidian A. (1987-1990), Yodgorov H.J. (1988-1993), Avanesov E.V. (1988-1999), Leonid Sitnikov (1990-1994), Ibragimov F.H. (1991-1996), Tadjiev B.A. (1991-1995), Shofayziev F.S. (1992-1995), Isroilova M.I. (1994-1997), Nurutdinov S. (1994-1995), Babamuradov T. (1994-1995), Kadirova M.U. (1994-1999), Nigmatov A.N. (1995-1999), Rahmankulov H.R. (1997-1999), Bekimbetov N.H. (1997-2003), Sarimsakov I.H. (2000-2003), Norimbetov N.S. (1998-2006), Karimov D.A. (2006-2007), Dusmanov A.H. (1995-2009). They created rich educational and methodical, scientific and material base for the further development of the department in preparation of young specialists in the sphere of civil and family law.
Doctor of law, associate professor Asyanova Sh.M. (1983-1997) and the Doctor of law, associate professor Tulteeva I.T. (1997-2000), Doctor of law, professor J.T. Holmuminova (2000-2008) made great contribution in formation of the staff, organization and creation of educational and methodical, scientific and material base. The fundamental task in this period was formation of the academic staff of the department, ensuring the preparation and adoption of new civil and civil procedural legislation.
Taking into account of the objective need in scientific and pedagogical staff of the chair has been formed a staff of young scientists including Muratov U.N. and Omonov R.Y., Shoimov N.B., Suvonkulov Z.L., Yusupov F.D., Zokirova I.N., Narmatov N.S., Kholikov Z.B., Tillaev T.N., Kamalov O.A., Kuldashev N.A., Qosimov B. Ubaidullazade N.T., Otamuradov A., head of the study support centre Khotamov B., and others.
When Uzbekistan gained its sovereignty there emerged a problem of developing a new civil legislation which was to create the legal basis of property relations in independent state. To fulfill this important task a state commission was established including Doctor of law, academician of the Academy of Sciences of the Republic of Uzbekistan, professor H.Rahmankulov, Doctor of law, associate professor Sh.M.Asyanov that studying the historical background of the development of civil legislation, discovered main reasons, goals and tasks of civil legal reforming and defined main theoretical approaches of constructing new Civil Code of the Republic of Uzbekistan in 1995.
With the adoption of the Constitution of the Republic of Uzbekistan in 1992 and the Civil Code of the Republic of Uzbekistan in 1995, a qualitative reformation of all study programs, educational-methodical materials and all lecture funds were prepared by the academic staff of the department reflecting the fact of creation of new civil legislation on the basis of the Constitution of independent Uzbekistan.
At present time, academic staff of the chair, applying the modern means, advanced methods and new innovative educational technologies provides teaching of «Civil law», «Civil and family process», «Financial law», «Labor law», «Ecological law».
For the improving the level of teaching assists research activities of the academic staff of the chair. During this period ten doctor’s dissertations were defended (Asyanov Sh.M., Avanesov E.V., Yodgorov H.J., Narmatov N.S., Kamalov O.A., Akhmanov N., Zakirov I.N., A.N. Shoimov B., Tillaev T.N, Kuldashev N.A.). In addition, educational-methodical and scientific-theoretical works have been published by the academic staff: H.R. Rahmankulov “General characteristics and commentaries to the first part of the Civil code of the Republic of Uzbekistan; Purchase and sale contract; Holmuminov J.T. Ecology and law; Civil and family law. Part 1: Album charts; Civil and family law. Part 2: Album charts; Civil and family law. Part 2: Album charts; Labour law: Album charts; Labour law: Album schemes; Album charts; Ecology law: Album charts; Ecology law: Album charts; Holmuminov Z.T. Ecology law of the Republic of Uzbekistan. Textbook; Holmo’minov J.T., Narmatov N.S. Bekimbetov H. Civil and family law. Part 1: Album charts; Civil and family law. Part 2: Album charts., Dusmanov A.H., T. Tillaev: Labour law: Album charts; Dusmanov A.H., T. Tillaev Civil procedure: collection of lectures; Labour law: Lectures courses; Holmuminov J.T., Narmatov N.S., Kuldoshev H. Civil and family law: collection of lectures; Dusmanov A.H., O.A.Kamalov Labour law: collection of lectures and three monographs, ten textbooks, more than a hundred scientific articles, commenting the novels reflecting the existing law were published.
Important direction of the department is to prepare bills adopted by the Oliy Majlis and resolutions of the plenary session of the Supreme Court and the Supreme Economic Court of the Republic of Uzbekistan and their reviewing. It should be noted that bills of some laws adopted in Uzbekistan related to civil and ecological-legal sphere are studied at the department. In addition, the department constantly prepares reviews on scientific works coming from other universities, practitioners and various departments of the Republic of Uzbekistan and other countries.
Department pays special attention to the preparation process of young scientific and academic staff of the Academy of MIA of the Republic of Uzbekistan. For these purposes, a scientific circle of listeners was established at the department. Under the guidance of the teachers, members of the circle prepare reports and information that are heard at the meetings of the circle and the most interesting works are presented to participation in the Olympiads held in the republic stage where they take honorable places every year.
The chair’s creative relations are being improved and expanded with other educational institutions and practical organs through having united research, scientific-practical conferences, seminars, debates, united publications and research works.
Today the chair continues to work actively on investigation of civil legal problems as civil-law problems on compensation of harm caused to the organs of internal affairs, the legal regulations of activities of the association «Protection» under the Ministry of Internal Affairs as a legal entity; application of civil law contracts to the activities of the organs of internal affairs.
The efforts of the chair are directed to the development of theoretical bases of contractual relations in the activities of the organs of internal affairs in condition of market economy; creation of national mechanism of the acting legislation and transformation of the institutions and law making experience of foreign legal systems in the civil structure of the Republic of Uzbekistan and others.
Nowadays the staff of the chair includes head of the chair is vacant, professor of the chair, Doctor of law, professor E. Egamberdiyev, associate professor Doctor of law Umaraliev V.E., assistant professor of the chair, doctor of law, associate professor N.A.Kuldashev, senior teachers doctor of law, associate professor Tillaev T.N., Holmuminov O.J., teachers Artikov B.A., head of educational and methodical office B.Musurmanov.
